Please read these terms carefully before using PulseTik Africa. By using our platform,
you agree to be bound by these terms and conditions.

1. Acceptance of Terms
By accessing and using PulseTik Africa ("the Platform"), you accept and agree to be bound by the terms
and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These Terms of Service ("Terms") govern your use of our website, mobile applications, and related services
provided by PulseTik Africa. These Terms constitute a legally binding agreement between you and PulseTik Africa.
2. Service Description
PulseTik Africa is a comprehensive digital platform that provides:

For Attendees
- • Event discovery and browsing
- • Secure ticket purchasing

- • Secure voting systems
- • Real-time results tracking
- • Transparent audit trails
Ecommerce Features
- • Product listings and showcases
- • Secure payment processing
- • Vendor management
- • Sales analytics
3. User Accounts
Account Creation
To use certain features of the Platform, you must create an account. You agree to provide accurate,
current, and complete information during the registration process and to update such information
to keep it accurate, current, and complete.
Account Security
You are responsible for safeguarding your account credentials and for all activities that occur
under your account. You must immediately notify us of any unauthorized use of your account or
any other breach of security.
Account Types
The Platform offers different account types (Attendee, Organizer, Vendor) with varying features
and capabilities. You may upgrade or change your account type at any time, subject to our approval.
4. Eligibility
To use the Platform, you must:
- • Be at least 18 years old or have parental consent
- • Have the legal capacity to enter into binding agreements
- • Not be prohibited from using the service under applicable laws
- • Provide accurate and truthful information
- • Comply with all applicable local, state, and international laws
Note: Some features may have additional age or eligibility requirements.
Event organizers are responsible for ensuring their events comply with age restrictions.
5. Fees and Payment
Transaction Fees
PulseTik Africa charges transaction fees only on successful sales. Our pricing is transparent:
- Events & Tickets: 4-5% per ticket sold
- Voting Contests: 20-30% per vote processed
- Ecommerce: 4-5% per transaction
Payment Processing
All payments are processed through secure, PCI-compliant payment gateways. We support multiple
payment methods including credit cards, mobile money, and bank transfers. Funds are held in
escrow until event completion.
Payout Terms
Successful payouts are processed within 2 business days of event completion. Multiple payout
options are available, and all withdrawals are subject to our anti-fraud measures.
6. Event Tickets
Ticket Sales
Event organizers set their own ticket prices and sales terms. All ticket sales are subject to
our transaction fees. Tickets are non-transferable unless explicitly stated by the organizer.
Refunds and Cancellations
Refund policies are determined by individual event organizers. PulseTik Africa facilitates
communication between buyers and organizers but does not process refunds directly. All refund
requests must be handled according to the organizer's published policy.
Ticket Validity
Digital tickets are valid only for the specified event and date. Lost or stolen tickets may
be replaced at the organizer's discretion. Physical tickets, if issued, must be presented at entry.
7. Voting and Contests
Voting Integrity
All voting contests are conducted with the highest standards of integrity. Our systems ensure
fair voting, prevent fraud, and maintain complete audit trails. Results are final and binding.
Contest Rules
Each voting contest has its own rules, eligibility requirements, and terms. Participants must
comply with all contest rules. Violation of rules may result in disqualification and account suspension.
Vote Purchasing
Premium voting options may be available for purchase. All vote purchases are final and non-refundable.
Vote manipulation or fraud will result in immediate account termination.
8. User Conduct
You agree not to use the Platform to:
- • Violate any applicable laws or regulations
- • Infringe on intellectual property rights
- • Harass, abuse, or harm others
- • Distribute malicious software or viruses
- • Attempt to gain unauthorized access
- • Post false or misleading information
- • Engage in fraudulent activities
- • Spam or send unsolicited messages
- • Interfere with platform operations
- • Create fake accounts or impersonate others
9. User Content
Content Ownership
You retain ownership of content you submit to the Platform. By submitting content, you grant
PulseTik Africa a non-exclusive, worldwide, royalty-free license to use, display, and distribute
your content in connection with the Platform.
Content Standards
All user content must comply with our content guidelines. We reserve the right to remove
content that violates these guidelines or applicable laws without prior notice.
Prohibited Content
Content that is illegal, harmful, offensive, discriminatory, or violates intellectual property
rights is strictly prohibited and will be removed immediately.
10. Privacy Policy
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference,
explains how we collect, use, and protect your personal information. By using the Platform, you consent
to our data practices as described in our Privacy Policy.

11. Termination
Account Termination
We may terminate or suspend your account immediately, without prior notice or liability,
for any reason, including but not limited to breach of these Terms.
Effect of Termination
Upon termination, your right to use the Platform ceases immediately. All provisions of these
Terms that by their nature should survive termination shall survive, including ownership provisions,
warranty disclaimers, and limitations of liability.
12. Limitation of Liability
To the maximum extent permitted by law, PulseTik Africa shall not be liable for any indirect,
incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Our total liability for any claim arising out of or relating to these Terms or the Platform
shall not exceed the amount paid by you to us in the 12 months preceding the claim.
Important: Some jurisdictions do not allow the exclusion or limitation of certain damages,
so some of the above limitations may not apply to you.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes
via email or platform notifications. Continued use of the Platform after changes constitutes
acceptance of the new Terms.
